Effective January 1, 2025, in addition to any other leave options available to them, including New York State Sick Leave, private sector employees now have 20 hours of paid leave time for covered prenatal health care services. New York State Paid Prenatal Leave Law covers all full time and part time private sector employees, including employees who are overtime exempt.
The 20 hours of paid leave time which are available immediately upon hire can be used per 52-week period but does not carry over. It covers appointment for physical exams, medical procedures, testing and monitoring, consultations, end of pregnancy care, and fertility treatment. The time can be used in hourly increments and employees can return to work for the remainder of the day. However, a spouse, partner, or other support person attending prenatal appointments with a pregnant person is not able to use Paid Prenatal Leave for these appointments.
An employer must allow an employee to use Paid Prenatal Leave when requested. An employer is not allowed to ask for any medical documentation regarding use of Paid Prenatal Leave.
New York is the first state in the United States to require employers to pay for prenatal personal care for their employees.
